Case Study: How We Turned a Denied Claim Into a $50,000 Settlement
At Cohen Injury Law, we know that not every personal injury case is straightforward, and not every lawyer gives each case the attention it deserves. This recent result is a perfect example of how digging deeper and putting pressure in the right places can make all the difference.
The Incident
Our client was stopped at a red light when, out of nowhere, the driver in front of him reversed and backed into the front of his car. After the minor impact, both drivers got out, looked over the damage, spoke briefly, and agreed there wasn’t much to worry about. They got back into their cars and drove away.
Our client’s car after the crash. The damage may look minor, but the legal fight was anything but simple.
A few moments later, our client noticed damage to his front bumper. He followed the other driver into a nearby bank parking lot, where they exchanged information. The other driver even helped snap the bumper back in place. They both left the scene, thinking it was handled.
The Denial
Two days later, our client began experiencing neck pain and sought medical treatment. When he reported the incident to the at-fault driver’s insurance company, the response was shocking: the defendant denied the crash ever happened. According to him, he wasn’t even at the bank that day.
Our client hired a lawyer. That lawyer worked on the case for six months with no results, and then dropped it. A second lawyer tried again and reached the same dead end. That’s when the client called us.
Our Approach
The first thing we did was file a lawsuit and schedule the defendant’s deposition. During the deposition, the defendant claimed he was at work all day and had never been at the bank.
We weren’t buying it.
We subpoenaed the defendant’s employer, and when she showed up for her deposition, she brought a critical piece of evidence: a check deposit slip showing the defendant was at the bank at the exact time of the crash.
In short, he had lied.
With this evidence, we were able to prove the defendant was at the scene, and within a week, we resolved the case for $50,000.
The Takeaway
Not every lawyer will fight the same way, and not every case is simple on the surface. Sometimes, it takes creative investigation and pressure in the right places to expose the truth and force accountability.
