Frequently Asked Question

Have Questions?

View our FAQs to learn more about personal injury cases.

What types of cases do you handle?

We handle a wide range of personal injury cases, including car accidents, slip and falls, negligent security, sexual assault, and other incidents involving serious injuries. If you’ve been hurt due to someone else’s negligence, we’re here to fight for you and your family. To see our full list, visit our Practice Areas (LINK) page.

How long do I have to file a personal injury case in Florida?

In most cases, you have two years from the date of the accident to file a personal injury lawsuit in Florida. This deadline applies to cases involving car accidents, slip and falls, negligent security, and other injury claims based on negligence. However, because the statute of limitations can vary based on the specific facts of your case, it’s important to speak with an attorney as soon as possible to avoid losing your right to your day in court.

How much does it cost to hire a Cohen Injury Law?

At Cohen Injury Law, we work on a contingency fee basis, which means you don’t pay anything up front. We only get paid if we win your case. If there’s no recovery, you owe us nothing.

I was in a car accident. What happens if the other driver doesn’t have insurance?

If the at-fault driver is uninsured or underinsured, you may still have options through your own insurance, such as uninsured/underinsured motorist (UM/UIM) coverage. We can review your policy and pursue every available source of compensation.

Will I have to go to court?

Not necessarily. Many personal injury cases settle without going to trial. However, if the insurance company refuses to offer a fair settlement, we’re fully prepared to take your case to court and fight for you.

What should I do after a car accident?

Here are the key steps:

  • Call the police and ask them to draft a crash report.
  • Document everything – take photos, write down witness names, and get a copy of the police report.
If you’re hurt, get medical treatment immediately
  • Don’t speak to the insurance company until you talk to a lawyer
  • Contact us as soon as possible for a free consultation
How long will my case take?

It depends. Some cases settle in a few months, while others may take over a year if litigation is necessary. We’ll keep you updated at every stage and push for the best result as efficiently as possible.

What should I do after a slip and fall?
  • Report it to the property owner or manager
  • Take photos and videos of the scene and what caused your fall
  • Document everything, including witness names and your version of events
  • Request an incident report, if available
  • If you’re hurt, see a doctor.
  • Contact us as soon as possible for a free consultation
What is PIP and why is it required in Florida?

PIP stands for Personal Injury Protection. It’s required in Florida and covers up to $10,000 in medical bills and lost wages regardless of who caused the crash. It’s part of your own auto insurance policy and kicks in before any other coverage.

Does PIP cover everything after a crash?

No. PIP covers up to 80% of medical bills and 60% of lost wages, up to $10,000 total. It does not cover pain and suffering or damage to your vehicle. If your injuries are serious, we pursue compensation from the at-fault driver’s insurance (if available) or your UM coverage.

Should I talk to the insurance company?

Not before speaking with us. Insurance adjusters are trained to protect their company, not you. They may try to get you to settle quickly or say something that hurts your claim. Let us handle the communication.
